The Department of Transport would like to communicate information received from the European Commission clarifying the smart tachograph version II retrofit obligations for passenger transport operators operating solely between the EU (including Ireland) and the UK (including Northern Ireland).
As advised on the RSA FAQ webpage, tachograph requirements for vehicles operating between the EU and UK differ, depending on whether the vehicle in question is transporting passengers or goods.
Vehicles transporting goods are subject to the smart tachograph version II retrofit obligation.
Vehicles transporting passengers solely between Ireland and the UK, and vice versa, are not required to be fitted with a smart tachograph version II. This is because the applicable rules governing tachographs for passenger transport between the EU and UK are set out in the European Agreement concerning the work of crews of vehicles engaged in international road transport (AETR), and not Regulation EU No. 165/2014 (which governs intra-EU transport operations for both passenger and goods transport). At present the AETR does not require a smart tachograph version II for journeys falling within its scope. The ultimate intention is that the AETR will align with EU rules so a retrofit for these vehicles may be required at some point in the future, however should this be the case the Department will reach out to impacted operators.
Therefore, if a vehicle is engaged solely in the transport of passengers across Ireland (either nationally or between Ireland and Northern Ireland) or between Ireland and Great Britain, and does not operate to another EU Member State, then no retrofit is required. However, should a passenger vehicle operate between Ireland and any other EU Member State (i.e. the journey comes within scope of Regulation EU No. 165/2014), then a smart tachograph version II is required for such vehicles from the below dates:
31 December 2024 for vehicles equipped with an analogue or digital non-smart tachograph (vehicles typically first registered prior to 14th June 2019).
18 August 2025 for vehicles equipped with a Smart Tachograph Version 1 (vehicles typically first registered between 15th June 2019 and 20th August 2023).
